The ERA has investigated seven electricity and gas retailers with residential and small business customers to determine if they breached their licences by overcharging customers and should be the subject of compliance enforcement action.
As a result of that investigation, we have issued Synergy with a second compliance enforcement notice. We have also published a short report detailing our investigation, and summarising our findings for the six other retailers.

Energy overpayments report

The ERA licences providers of electricity, gas and water services in Western Australia. We monitor compliance with the conditions of these licenses, including adherence with relevant Codes intended to protect the interests of consumers. Where necessary, we may take compliance enforcement action against companies found to have breached their licences.
We also:
- Approve and publish some standard documents related to licences.
- Monitor and report to the relevant Minister on the operation of licensing schemes.
- Arrange regular performance audits and asset management system reviews to ensure companies are complying with the conditions of their licences.
- Monitor the performance of licensees through the annual collection of data.
