Note: During 2011, WA Gas Networks Pty Ltd (WAGN) became known as ATCO Gas Australia Pty Ltd (ATCO).
On 29 January 2010 WA Gas Networks lodged its proposed access arrangement for the third access arrangement period.
The ERA issued a draft decision on 17 August 2010 to not approve WAGN’s proposal. WAGN submitted an amended proposal in response to the draft decision on 8 October 2010.
On 28 February 2011, the ERA published its final decision to not approve WAGN’s amended access arrangement proposal. The ERA published a further decision to give effect to its own access arrangement on 28 April 2011. This decision was a reviewable regulatory decision and determined that the access arrangement would take effect from 12 May 2011, with the reference service tariffs to take effect from 1 July 2011.
On 19 May 2011, ATCO and Alinta Sales Pty Ltd applied to the Australian Competition Tribunal for a review of the ERA’s regulatory decision. Tribunal hearings were held on 17-20 April 2012. The Tribunal delivered its decision on 8 June 2012.
On 25 June 2012, the ERA published a revised decision to reflect the orders of the Tribunal, with the resulting amendments to the arrangement taking effect from 1 July 2012. The ERA published amended access arrangement information that reflected its revised decision on 2 July 2012.
