On 31 December 2014, DBNGP (WA) Transmission Pty Ltd (DBP) submitted proposed revisions to the access arrangement for the Dampier to Bunbury Natural Gas Pipeline (DBNGP).
On 22 December 2015, the ERA published a draft decision, which rejected DBP’s access arrangement proposal. DBP submitted its response to the draft decision on 22 February 2016. Additional submissions from DBP and other public submissions in response to the draft decision were received and published by the ERA during March and April 2016.
On 1 June 2016 the ERA published a notice seeking public comment on a proposed required amendment to capacity expansions that it was considering as part of its final decision.
On 30 June 2016 the ERA published its final decision to not approve DBP’s access arrangement proposal and published its own access arrangement for the DBNGP.
On 20 July 2016, the Access Arrangement, Access Arrangement Information and the T1, P1 and B1 Terms and Conditions were republished to correct some formatting, referencing and typographical errors in the documents.
DBP challenged the ERA’s final decision on the access arrangement for the DBNGP before the Australian Competition Tribunal. The contested matters were presented at a hearing in February 2017.
On 16 July 2018, the Tribunal dismissed DBP’s hearing application and upheld the ERA’s June 2016 final decision and approved access arrangement for the DBNGP.
