On 13 January 2021 Australian Western Railroad Pty Ltd made access proposals to Arc Infrastructure Pty Ltd for use of part of Arc’s freight network in the south-west of Western Australia. On 23 March 2021 the ERA approved Arc entering into negotiations on AWR’s proposals.
Incremental and Total Costs Determination
Arc provided AWR with its determination of the floor and ceiling prices that would apply, and the underlying costs. The ERA assessed Arc’s determination and did not approve the costs. On 22 March 2021 the ERA issued a notice that it had made its own determination of the costs to apply.
Section 10 Decision
The ERA consulted with the public on Arc's request for approval to enter into negotiations with AWR. The ERA issued its decision on 23 March 2021 to approve Arc entering into negotiations
