Investigation on Vinalco Energy Pty Ltd

The ERA monitors the effectiveness of the wholesale electricity market (WEM) in meeting the wholesale market objectives in conjunction with the Independent Market Operator (IMO). This includes monitoring market behaviour and the application of market rules.

Market participants of WEM can notify the ERA of any behaviour that reduces the effectiveness of the market.

On 23 June 2014, the IMO advised the ERA of an alleged breach of the market rules by Vinalco Energy Pty Ltd (Vinalco Energy). On 4 July 2014 the ERA issued a notice advising it has commenced an investigation into the alleged breach.

On 28 July 2014, the IMO advised the ERA of an alleged breach of the market rules by Vinalco Energy. On 18 August 2014, the ERA issued a notice advising it has commenced an investigation into the alleged breach.

On 19 December 2014, the ERA issued a notice advising it has decided to extend the time to complete the two investigations into Vinalco Energy’s pricing behaviour to 30 April 2015.

The ERA issued a notice on 29 April 2015 advising it has decided to extend the time to complete the two investigations into Vinalco Energy’s pricing behaviour to 30 June 2015.

The ERA issued a notice on 26 June 2015 advising it has decided to extend the time to complete the two investigations into Vinalco Energy’s Pricing Behaviour to 30 October 2015.

On 30 October 2015, the ERA completed its investigations and published its findings in relation to:

  • First Investigation into Vinalco Energy Pty Ltd (Vinalco) pursuant to clause 2.16.9E of the Wholesale Electricity Market Rules; and
  • Second Investigation into Vinalco Energy Pty Ltd (Vinalco) pursuant to clause 2.16.9E of the Wholesale Electricity Market Rules.

The ERA's findings are provided below.

The ERA will not make further public comments about the pricing behaviour of Vinalco.
