There is a legal requirement to obtain an electricity licence if you intend to:
- construct or operate generating works
- construct or operate a transmission system of a voltage of 66kV or higher
- construct or operate a distribution system of a voltage of less than 66kV
- sell electricity to customers.
The requirement for an electricity licence is established by the Electricity Industry Act 2004.

Activities that do not require an electricity licence
Activities that fall outside of the scope of the law include:
- Self-supply - if the generating works, transmission system or distribution system is to be used solely for the supply of electricity for consumption by the person who owns, controls or operates the works or system or a related body corporate of that person.
- Sale of electricity to a person who is not the end use customer. For example, a generator who sells electricity solely to retailer(s) is not required to hold an electricity retail licence.
Exemptions from holding an electricity licence
